DMCA Overview

The DMCA is a United States copyright law that aims to balance the interests of copyright holders and users of copyrighted material in the digital age. It establishes a system for copyright holders to report instances of alleged copyright infringement and request the removal of infringing material from online platforms.

Applicability

This DMCA Policy applies to the use of Miydi’s cloud services and any user-generated content hosted on our platform.

Copyright Infringement Notification

To report instances of alleged copyright infringement, copyright holders or their authorized agents may submit a DMCA takedown notice to Miydi’s designated agent. A valid notice must include the following elements:

• Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
• Identification of the material that is claimed to be infringing, including its location on the platform.
• Contact information for the complaining party, such as an address, telephone number, and email address.
• A statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
• A physical or electronic signature of the copyright owner or their authorized agent.

Miydi will respond to valid DMCA takedown notices by removing or disabling access to the allegedly infringing material and notifying the affected user.

Counter-Notification

If a user believes that their content was wrongfully removed due to a DMCA takedown notice, they may submit a DMCA counter-notice to Miydi’s designated agent. A valid counter-notice must include the following elements:

• Identification of the material that has been removed or to which access has been disabled and its location before removal or disabling.
• A statement, under penalty of perjury, that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• The user’s contact information, including their name, address, telephone number, and email address.
• A statement that the user consents to the jurisdiction of the federal district court in which their address is located and will accept service of process from the person who submitted the original DMCA takedown notice or their agent.
• A physical or electronic signature of the user.

Miydi will respond to valid DMCA counter-notices by restoring access to the removed material, unless the copyright holder initiates legal action to prevent the restoration.

Repeat Infringers

Miydi has a policy for dealing with repeat infringers, which may include issuing warnings, suspending or terminating user accounts, or restricting access to our cloud services.
